Sumario: ABSTRACT. This research study was carried out in the city of San Antonio, in the department of Suchitepéquez, which analyzes the application of Decree 34-2003, objectively demonstrating that theory and practice on multiple occasions is disconnected in all the splendor of its word . Likewise, the requirements, prohibitions, exceptions, as well as the resources and sanctions that are typified in said decree are met, it is necessary to indicate that in the country there are different administrative, national and international entities, with competence at the national level specifically in charge of environmental management in its different topics. However, the municipalities, as autonomous entities, are in charge of carrying out and administering the necessary services in the development of said districts, therefore, these legal entities must have full knowledge of the territorial organization of which they are in charge. In addition to the above, it is asserted that the Political Constitution of the Republic of Guatemala: Article 97, Environment and ecological balance: “The State, the municipalities and the inhabitants of the national territory are obliged to promote social, economic and technological development that prevent the pollution of the environment and maintain the ecological balance. All the necessary norms will be dictated to guarantee that the use and exploitation of fauna, flora, land and water are carried out rationally, avoiding their predation”.
